Terms of Service

The short version. This page covers your use of the Hearth website. It does not license the Hearth software. If you buy Hearth, what you may and may not do with the software is governed by the Hearth End User License Agreement, which is provided with purchase and available on request before you buy.

1. Who we are, and what you are agreeing to

This website, gethearth.dev (the "Site"), is operated by Nick Allen ("we", "us"). By accessing or using the Site, you agree to these Terms of Service (the "Terms"). If you do not agree, please do not use the Site.

We may update these Terms from time to time. Changes take effect when posted, and the "Last updated" date above will change. Your continued use of the Site after a change means you accept the revised Terms.

2. What this Site is

The Site is an informational and marketing website describing the Hearth software. It is not the software itself, and it is not a service for hosting meetings. Nothing on the Site creates a support, hosting, or service relationship.

3. The software is licensed separately

Hearth is proprietary software. It is not open source, and no rights to it are granted by visiting the Site, by expressing interest, or by these Terms. Any right to install, run, copy, or use Hearth arises only under a purchased license, on the terms of the Hearth End User License Agreement (the "EULA"). Where these Terms and the EULA differ about the software, the EULA controls.

4. Early access, and statements about the future

Hearth is offered on an early access basis. Descriptions of features, capacity, performance, roadmap, and availability reflect our current intentions and are not promises or contractual commitments. Features may change, be delayed, or be removed before or after general availability. Comparisons to other products reflect publicly available information believed accurate when written, which may since have changed.

5. Pricing and purchases

Prices shown on the Site are stated in US dollars and are provided for information only. They are an invitation to enquire, not a binding offer.

6. Intellectual property

The Site and its contents, including text, layout, design, graphics, the Hearth name, and the Hearth logo and marks, are owned by us or our licensors and are protected by copyright, trademark, and other laws. Except as set out below, you may not copy, reproduce, republish, or create derivative works from the Site.

You may view the Site, and quote short excerpts with attribution and a link, for ordinary reference, journalism, commentary, or review.

The Site and the Hearth software include or depend on third party open source components, which remain governed by their own licenses and notices. Nothing here restricts your rights under those licenses to those components themselves.

7. Acceptable use

You agree not to:

Ordinary search engine and AI assistant crawling that respects our robots.txt is welcome and expressly permitted.

8. Links to other sites

The Site may link to third party websites and resources. We do not control them, do not endorse them by linking, and are not responsible for their content, products, or practices. Your use of a linked site is governed by that site's own terms.

9. Privacy

Our handling of information collected through the Site is described in our Privacy Policy, which forms part of these Terms.

10. Disclaimer

THE SITE AND ITS CONTENTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON INFRINGEMENT, OR ACCURACY.

We do not warrant that the Site will be uninterrupted, error free, or free of harmful components, or that information on it is complete, current, or accurate. Content may contain errors or become out of date, and we may change or withdraw any part of the Site at any time.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE AND THESE TERMS WILL NOT EXCEED ONE HUNDRED US DOLLARS (US$100). Liability for the Hearth software, if you purchase it, is addressed separately in the EULA.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence. Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you.

12. Indemnity

You agree to indemnify and hold us harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your misuse of the Site or your breach of these Terms or of applicable law.

13. General

If any provision of these Terms is held unenforceable, that provision will be limited or severed to the minimum extent necessary and the remaining provisions will stay in full force. Our failure to enforce any provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Site.
