Privacy Policy

1. Scope

This policy explains how Nick Allen ("we", "us") handles information collected through the website gethearth.dev (the "Site"). It does not apply to the Hearth software once you deploy it. When you run Hearth, you are the controller of the data in your own deployment, and we have no access to it.

2. What we collect

Analytics

We use a privacy oriented analytics product (Vercel Web Analytics) to understand how the Site is used, for example which pages are visited and which sources send traffic. This is served from our own domain rather than a third party tracking domain. It collects aggregate usage information, which may include:

• pages viewed and the order they were viewed in;
• the referring site or campaign, if any;
• approximate location at country level, derived from your IP address;
• device type, browser, and operating system.

As currently configured, this analytics does not use cookies and does not track you across other websites. We may change this in future, including by introducing cookies or similar technologies, for analytics, advertising, or measuring the effectiveness of marketing. If we do, we will update this policy and, where the law requires consent, we will ask for it before those technologies are used.

Local storage

If you dismiss the notice banner on the Site, we store a single flag in your browser's local storage (hearth-notice-dismissed) so it does not reappear. It is a record of a preference, it contains no identifier, it is never sent to us, and you can clear it in your browser at any time.

Information you send us

If you email us, for example about early access or a purchase, we receive whatever you choose to include: typically your name, email address, organization, and the content of your message. We use it to reply to you and, if you become a customer, to deliver and support your license.

Server logs

Our hosting provider processes standard request information, including IP addresses, in order to serve the Site and to maintain its security and integrity.

3. What we do not do

• We do not sell or rent personal information.
• We do not share it with data brokers.
• We have no access to any Hearth deployment or anything in it.

4. Why we process this information

We process it to operate, secure, and improve the Site, to understand whether our marketing works, and to respond to enquiries and support customers. Where the UK or EU GDPR applies, our legal basis is our legitimate interest in running and improving a business website and in communicating with people who contact us, and, where we later rely on consent for cookies or similar technologies, that consent. Where we process information to perform a contract with you, such as delivering a license you purchased, the basis is performance of that contract.

5. Who we share it with

We share information only with service providers who process it on our behalf, under contract, for the purposes described above:

• Vercel (website hosting and analytics);
• Google (email, as our mail provider, for correspondence you send us).

We may also disclose information where required by law, or to establish, exercise, or defend legal claims.

6. International transfers

We operate from the United States and our providers may process information in the United States and elsewhere. If you are in the UK, EU, or another region with data transfer rules, your information may be transferred outside your region, protected by appropriate safeguards such as standard contractual clauses where required.

7. Retention

Analytics information is retained in aggregate for as long as it is useful for understanding traffic trends, subject to our provider's retention periods. Email correspondence is retained for as long as needed to answer you, and, for customers, for as long as needed to support the license and to meet legal, tax, and accounting obligations.

8. Your rights

Depending on where you live, you may have rights to access, correct, delete, port, or restrict the processing of your personal information, to object to processing based on legitimate interests, and to withdraw consent where we rely on it. If you are in California, you have rights to know, delete, and correct, and a right not to be discriminated against for exercising them. We do not sell or share personal information as those terms are defined by California law.

To exercise any right, email nick.k.allen92@gmail.com. We will respond within the time the applicable law requires. You may also complain to your local data protection authority, though we would appreciate the chance to help first.

9. Do Not Track and opting out

The Site does not currently respond to browser Do Not Track signals, as there is no common standard for them. Because our analytics is cookieless and aggregate, there is no per person profile to opt out of. You can also block the analytics script with any standard content blocker, and the Site will work normally.

10. Children

The Site is aimed at businesses and is not directed at children under 13, and we do not knowingly collect their personal information.

11. Security

We take reasonable measures to protect information we hold. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

12. Changes

We may update this policy from time to time. The "Last updated" date above will change, and material changes will be reflected on this page. Where the law requires consent for a new use, we will ask before making that change effective.
